Punkt. Affiliate Programme – Terms and Conditions

Last updated: 27/10/2026

These Terms and Conditions ("Terms") govern application to and participation in the Punkt. Affiliate Programme (the "Programme"), operated by Punkt Tronics AG, Via Losanna, 4 – 6900 Lugano, Switzerland ("Punkt.", "we", "us"). By submitting an application, you ("Affiliate", "you") agree to these Terms. Your participation and your right to use Programme links, codes and materials begin only when we approve your application. If you apply on behalf of a business, “you” and “Affiliate” refer to that business.

1. Joining the programme

1.1 Applications are reviewed by Punkt. We may accept or decline any application at our discretion, subject to applicable law. Approval will be communicated by email or through the affiliate portal. Submitting an application does not guarantee acceptance.

1.2 If you apply as an individual, you must be at least 18 years old and have legal capacity to enter into these Terms. If you apply on behalf of a business, you must have authority to bind it.

You must provide accurate, complete information when registering. Please keep your details, including tax and payout information, up to date.

1.3 You participate independently and on a non-exclusive basis. You decide whether, when and how to promote eligible products, subject to these Terms, and have no minimum sales or continuous promotional obligation.

Participation does not create an employment relationship, partnership, joint venture or agency between you and Punkt.

You have no authority to negotiate or conclude contracts, collect payments, give warranties or make commitments on behalf of Punkt. The legal classification of the relationship and any mandatory rights are determined by applicable law and the actual circumstances.

1.4 You must keep your login credentials secure, limit access to authorised persons and notify us promptly of suspected unauthorised access or changes to your account or payout details. You remain responsible for activity you authorise through your account. You may not transfer your account or reassign your Programme links or codes without our written approval.

2. How it works

2.1 After approval, you receive a personal referral link and/or discount code through the affiliate portal. You may share them through your disclosed promotional channels in accordance with these Terms. The portal is available at punktch.goaffpro.com.

2.2 Customers who use your link or code receive a 10% discount on eligible products purchased on punkt.ch using your valid discount code. The discount cannot be combined with other discount codes or promotions, unless Punkt. states otherwise. Customer prices, availability and purchase conditions are determined at checkout.

2.3 An eligible order is attributed to you when the customer uses your valid discount code, or completes a purchase within 30 days of clicking your qualifying referral link, in line with the tracking settings of the affiliate portal. An order is attributed to only one Affiliate; if several Affiliates are involved, the last referral before the purchase applies.

2.4 Referral tracking may be affected by the customer's browser and cookie preferences. Where an order cannot reliably be attributed, commission is not automatically payable merely because you believe that you referred the customer. Punkt. is not responsible for orders that cannot be tracked for technical reasons, if you believe an order was incorrectly recorded or omitted, contact us promptly with the available supporting information. We will investigate reasonable claims in good faith and correct substantiated errors.

2.5 Customer sales are concluded directly between Punkt. and the customer under the applicable Terms and Conditions of Sale, available at punkt.ch/policies/terms-of-service. You cannot vary those conditions or make additional promises about prices, delivery, returns, warranties, software or subscriptions on Punkt.’s behalf. Customer service requests must be directed to Punkt.’s official support channels.

3. Commission

3.1 You earn a commission of 8% on the net value of the products in each eligible order attributed to you under clause 2.3. Net value means the amount actually paid for the products after discounts, excluding VAT and other taxes, shipping costs, duties, gift cards and separately charged fees.

3.2 No commission is paid on:

  • orders that remain unpaid, are cancelled or subject to a chargeback, returned or refunded, in full or in part (for partial returns, the commission is adjusted accordingly);
  • orders placed by you or on your behalf, or through your own link or code;
  • fraudulent, fictitious or duplicate orders;
  • orders obtained in breach of these Terms;
  • orders from business (B2B) or retail customers, unless agreed in writing.

3.3 Commissions are confirmed once the withdrawal notification period has passed, currently 30 days after delivery. Until then they are shown as pending. We will validate commissions and resolve pending adjustments without undue delay.

3.4 Punkt. may change commission rates or eligible products by giving at least 14 days' advance notice through the affiliate portal or by email, with the updated information also available through the portal. The notice will identify the changes and their effective date.

Commissions applicable when a qualifying order was placed are not affected, even if its commission is still pending. Your right to reject material changes is set out in clause 11.1.

3.5 If an order is later refunded, charged back or found to involve fraud, duplication or a calculation error, we may correct the affected commission, including after confirmation or payment. We will explain material adjustments and give you a reasonable opportunity to query them. A genuine overpayment may be deducted from future commissions or recovered from you, subject to applicable law. Unrelated commissions remain payable. A repair or replacement that does not reduce the eligible amount paid by the customer does not, by itself, reverse commission.

3.6 You can access statements showing attributed transactions, pending and confirmed commissions, adjustments and payouts through the portal. Please report discrepancies within 30 days after the relevant statement becomes available, or as soon as reasonably possible after discovering them. This reporting period does not extinguish statutory claims or mandatory verification rights. Subject to reasonable confidentiality and data-protection safeguards, we will provide information reasonably necessary to investigate a disputed statement.

4. Payments

4.1 Confirmed commissions are paid monthly, by the 15th of the following month, once your balance reaches at least CHF 50. Balances below this amount are carried over. When participation ends, any valid remaining balance will be paid on the next applicable payment date after validation, without the minimum threshold. We will explain any payment delay caused by missing information or an unresolved dispute and pay unaffected amounts when due.

4.2 Payments are made in CHF via PayPal or bank transfer to the verified payout details provided in your account. Where an eligible order is recorded in a different currency, its commission is converted using the exchange rates published by the Swiss Federal Office for Customs and Border Security (FOCBS) at payout date, with the conversion shown in your statement. You are responsible for any fees charged by your bank or payment provider.

4.3 You are responsible for declaring and paying your own income taxes, VAT or social contributions arising from your participation, except to the extent that applicable law places an obligation on Punkt. Where required, payment is subject to a valid invoice or an agreed, legally compliant self-billing arrangement. We may make deductions or withholdings required by law and will provide the relevant information.

4.4 You bear your own promotional and operating costs unless Punkt. agrees to reimburse specific expenses in advance in writing. Participation does not guarantee earnings, sales volumes, product availability or the duration of any campaign.

5. Promotion rules

5.1 You must clearly and prominently disclose your commercial relationship with Punkt. whenever you share Programme links or codes, for example with "ad", "affiliate link" or "I earn a commission", readily visible without requiring users to search for it, in line with the rules of your country and of the platform you use.

5.2 You must not:

  • bid on search ads for "Punkt", "Punkt.", product names (such as MC03, MC02, MP02, AC02, UC01) or misspellings of them, on Google, Microsoft Advertising, Brave or any other search engine;
  • use "Punkt" or product names in domain names, social media handles or advertising accounts in a way that suggests an official Punkt. account, or otherwise do so without our written approval;
  • publish Programme codes on coupon, voucher or cashback websites;
  • send unlawful unsolicited marketing messages (spam) or use misleading pop-ups, cookie stuffing, fabricated traffic, bots, forced clicks or redirects, unauthorised browser extensions or similar methods to manipulate attribution;
  • generate fraudulent orders, disguise self-purchases or interfere with another Affiliate’s attribution;
  • make false or misleading claims about Punkt., its products, prices, privacy or security features, availability or delivery;
  • present yourself as Punkt. or act as an official Punkt. representative;
  • promote Punkt. alongside content that is illegal, discriminatory, violent or otherwise harmful to the brand.

Affiliates must also take reasonable steps to exclude these terms from broad-match and automated campaigns where necessary.

Notify us promptly if you become aware of a material code leak and reasonably cooperate in addressing it. Honest reviews remain protected under clause 7.2.

5.3 Product information must be kept accurate and up to date. When in doubt, refer to the official product pages on punkt.ch or ask us. If we identify a material factual error or unlawful or misleading promotion, you must promptly correct it or remove the affected promotional material following reasonable notice. We may require immediate removal where reasonably necessary to stop unlawful content, serious customer deception or misuse of our brand. This does not require you to change an honestly held opinion or give a positive review.

6. Brand assets

6.1 During your participation, Punkt. grants you a limited, non-exclusive, non-transferable, revocable licence to use the logos, images and materials supplied for the Programme, provided in the affiliate portal, solely to promote Punkt. under these Terms. We may withdraw or replace particular assets by reasonable notice, or immediately where necessary to address unlawful use, third-party rights or a serious breach. Termination of the licence is subject to clause 8.3 and any rights that cannot lawfully be restricted.

6.2 You may resize, crop or reformat supplied materials as reasonably needed for the approved format, provided you do not alter the materials or use them for any other purpose. All intellectual property remains with Punkt. or its licensors. Rights in original content you create remain with you or the relevant rights holder, subject to Punkt.’s rights in its own materials and brands. Participation alone does not give Punkt. a licence to reuse your content, name or image.

6.3 With your prior written approval for the relevant content and use, Punkt. may repost content you create on the channels and for the period agreed with you. Unless otherwise agreed, that permission is non-exclusive and royalty-free for the approved reposting, with attribution where reasonably practicable.

7. Review units

7.1 Devices supplied as review loans remain the property of Punkt. unless agreed otherwise in writing. You must take reasonable care of the device and accessories, use them lawfully and return them using the prepaid label provided, within the agreed date. If no return date was agreed, return them within 14 days after our written request.

You are responsible for loss or damage caused by your failure to exercise reasonable care, excluding ordinary wear from authorised use. Before return, remove your accounts, SIM cards and personal data and follow our reasonable reset instructions. Any shipping, customs or import responsibilities beyond the prepaid return shipment will be agreed in advance.

7.2 Receiving a review unit does not oblige you to publish a positive review. We only ask that your content is honest and factually accurate. Punkt. may request correction of factual inaccuracies but will not require a positive assessment as a condition of receiving commissions otherwise validly earned.

8. Termination

8.1 Participation continues until terminated. Either party may terminate by giving 30 days’ notice by email; you may also use a termination function made available in the portal.

8.2 Punkt. may suspend or close your account at any time, with immediate effect where reasonably necessary to investigate suspected fraud, unlawful conduct, a breach of these Terms or an account security issue. For a remediable breach, we will normally give notice and a reasonable opportunity to remedy it. Either party may terminate immediately for good cause. We may withhold commissions reasonably affected by an investigation and reject or reverse commissions attributable to fraudulent orders or orders generated in breach of these Terms, but unrelated commissions validly earned remain payable. Our rights to recover proven losses remain subject to applicable law.

8.3 When your participation ends, you must stop using Programme links, codes and Punkt. materials without undue delay. Valid and confirmed commissions earned in line with these Terms will be paid out according to section 4. Accrued payment rights, confidentiality and provisions intended to operate after termination survive. Any mandatory commission, inspection or clientele compensation rights remain unaffected.

9. Liability

9.1 Nothing in these Terms excludes or limits liability for intentional misconduct, gross negligence, death or personal injury caused by fault, or any other liability that cannot lawfully be excluded or limited.

Subject to those exceptions, Punkt. is not liable for indirect or consequential losses, lost profits or interruptions of the affiliate portal or tracking. Our total liability towards you is limited to the commissions paid to you in the 12 months before the claim.

9.2 You are responsible for your own content and agree to hold Punkt. harmless against reasonable losses and defence costs arising from third-party claims to the extent caused by your breach of these Terms or of applicable law, or infringement of third-party rights.

This does not apply to the extent the claim results from materials supplied by Punkt. and used as authorised, Punkt.’s instructions or Punkt.’s own conduct.

Punkt. will notify you promptly of the claim and give you a reasonable opportunity to participate in its defence. No settlement for which reimbursement is sought from you may be agreed without your consent, which must not be unreasonably withheld.

10. Privacy

10.1 We process your personal data as described in the Affiliate Programme Privacy Policy, available in the affiliate portal and at punkt.ch/pages/punkt-affiliate-programme-privacy-policy.

10.2 You must comply with applicable privacy, cookie and electronic marketing rules when operating your own websites, accounts and audience communications. Do not provide audience or customer lists to Punkt., collect personal data on Punkt.’s behalf or introduce tracking on its behalf without prior written approval and the legally required arrangements.

Each party’s data-protection role is determined by its actual activities; these Terms do not override any controller, joint-controller or processor responsibilities arising under applicable law.

11. Changes to these terms

11.1 We may update these Terms to reflect changes in law, products, security, the platform, operational requirements or the Programme’s commercial arrangements. Material changes will be communicated at least 14 days in advance. By continuing to participate after that date, you accept the updated Terms. If you do not accept a material change, you may terminate participation with immediate effect before it takes effect.

12. Governing law and jurisdiction

12.1 These Terms are governed by Swiss law. The courts of Lugano, Switzerland have exclusive jurisdiction, subject to any mandatory applicable law or jurisdiction.

13. Confidential Information

13.1 If Punkt. gives you information identified as confidential, or reasonably understood to be confidential from its nature or the circumstances, use it only for the agreed Programme purpose and do not disclose it without approval. This includes non-public launch plans, specifications and commercial information. Follow any embargo expressly agreed with you before disclosure.

13.2 This obligation does not cover information that is public without your breach, was already lawfully known to you, is independently developed or is lawfully obtained from another source.

You may disclose information to professional advisers bound by confidentiality or where required by law, giving prior notice where lawful and reasonably practicable.

Confidentiality continues for three years after participation ends and, for trade secrets, for as long as they remain trade secrets, subject to applicable law.
